A woman was seen by her family physician three times for such symptoms as nausea, fever and weight loss. After receiving diagnoses of upper respiratory infection and viremia, she finally was admitted to Michael Reese Hospital. She was diagnosed with pneumonia, suffered cardiopulmonary arrest and died shortly after midnight. We sued on behalf of her estate and contended that the physician should have included pneumonia in his diagnosis and should have ordered chest x-rays which would have revealed pneumonia. We sought survival and wrongful death damages. Our cross-examination secured the defense expert's admission that not ordering a chest x-ray was a deviation from the standard of care. After nine hours of deliberation, the Cook County jury found for our client, a verdict that ultimately resulted in $1.7 million in compensation.
