Jenny (62) underwent her seventh spinal surgery on July 11, 2013, during which, she allegedly sustained a spinal cord injury at C5 that caused paralysis. The damage might have been avoided had deft orthopedic surgeon and the attending neuro-technician properly responded to the loss of SSEP signals that occurred during the procedure. Upon awakening from surgery, Jenny suffered cardiac arrest, possibly as a result of the injury. Defts maintained that Jenny's spinal cord injury occurred during cardiac arrest and there was no negligence on their part. Jenny passed away on March 29, 2014 (survived by two children). She had incurred $840,430 in medical expenses. Self-insured Franciscan Alliance d/b/a St. James Hospital paid $1,300,000; ISMIE paid $925,000 for undisclosed orthopedic surgeon; and NORCAL Mutual paid $775,000 for NuWave Monitoring and the neuro-technician.
