Our clients were the grandparents and co-guardians of a 9-year-old girl who had the developmental, motor and language skills of a 3-year-old due to brain injuries that she received a birth. We demonstrated that multiple deviations from the standard of care were committed by the physicians and nursing staff involved in the birth procedures. For example, the child's first-time mother, who was not contracting, came to the hospital with decreased fetal movement and other potential negative indicators concerning her baby. The doctors induced labor but failed to carefully monitor the medication they gave. The result was severe oxygen deprivation (hypoxic ischemic encephalopathy) that caused traumatic brain and neurological injuries, leaving the girl catastrophically disabled. Our mediated settlement will enable the girl's family to give her the physical and educational care she will need for the rest of her life.
